West Virginia criminal defense attorney Jason Glass secured a not guilty verdict for his client, Charles Lamp, last week. It took a Harrison County jury just forty-five (45) minutes to deliberate and find Mr. Lamp not guilty of Third Degree Sexual Assault.
Mr. Lamp was accused of having sex with a 14 year old girl on two separate occasions in December 2010, allegations that Mr. Lamp steadfastly denied.
During trial, the state presented testimony from the alleged victim and her mother. The testimony was wrought with contradictions and inconsistencies. Not only was there no physical evidence and a delayed disclosure, the mother testified that the victim had recanted several times before the police were involved with the case, and the alleged victim herself testified that the statement she gave to a DHHR investigator was not true. Upon cross-examination by Mr. Glass, the alleged victim repeatedly changed her testimony and contradicted herself over and over again.
In the end, there was simply no reliable evidence presented to the jury that would allow them to find Mr. Lamp guilty beyond a reasonable doubt.
